The indictment revealed that the hotel was at risk of collapsing even without an earthquake, the foundation was laid without obtaining a ground survey report, the permit was arranged as "residential," it was built as 13 floors instead of the permitted 9, and a "secure" report was obtained when the permit was converted to a 'hotel.'

The indictment with 11 defendants provides details of the scandals regarding the hotel building, stating that the foundation was laid without obtaining a ground survey report, the permit was arranged as "residential," it was allowed to be built as 13 floors despite the permit being granted for 9 floors, and a report from engineers stating "the building is solid" was obtained when converting the permit to a hotel. The indictment also highlighted that the problem of the illegal floor was resolved in 2018 with the amnesty for zoning violations and emphasized the use of sea sand in the building. The indictment stated, "It is quite predictable that the building will collapse if an additional floor is added, but the suspects carried out their actions thinking that the result would not occur due to different factors." The prosecutor, instead of the "possible intent" regulation that would lead to punishments such as "murder," filed a lawsuit for the crime of "causing death by conscious negligence" that would result in a maximum of 22.5 years in prison.

11 Defendants Including the Hotel Owner

Details of the indictment prepared by the Adıyaman Chief Public Prosecutor's Office regarding the İsias Hotel, which collapsed during earthquakes centered in Kahramanmaraş, leading to the death of 72 people, including athletes, teachers, and tour guides from the Turkish Republic of Northern Cyprus, have been revealed. The indictment, prepared for 11 defendants, including the hotel owner Ahmet Bozkurt, five of whom are in custody, was accepted by the Adıyaman 3rd Heavy Penal Court. The indictment, in which the Prime Minister of the TRNC, Ünal Üstel, also participated as an injured party, included the expert report prepared by the Department of Civil Engineering at Karadeniz Technical University, stating that the defendants were at fault.
