Chief Justice Özerdağ: Handcuffing Must Follow Clear Rules
Chief Justice of the High Court, Bertan Özerdağ, made a statement regarding the recent handcuffing of a lawyer brought to court for bail. Özerdağ emphasized that, unless absolutely necessary, handcuffing individuals during court appearances violates universal legal principles. He noted that many people have suffered due to inconsistent practices over the years and that similar issues persist today.
Özerdağ stressed the importance of upholding the presumption of innocence. He called for clear, transparent, and binding rules on when handcuffs may be applied during court proceedings to be implemented urgently.

“Today, the handcuffing of a lawyer appearing in court for bail is not in line with universal principles and demonstrates the ongoing grievances experienced by many over the years, as well as the lack of consistency in practice. Unless strictly necessary, handcuffs should not be applied, and the presumption of innocence must be considered. Clear and transparent rules regarding when handcuffs are to be used should be implemented without delay, which is the expectation of the Court.”
